My Agent, Dave Lindsay prepared the documents for the Motion filed on June 18th, 2000 and the documents for the court appearance on July 20, 2000. The only compensation that Dave accepted from me was his July plane fare and accommodations while he stayed in Ottawa. I am grateful indeed to Dave Lindsay for the great amount of time that he invested for my CCRA challenge.

Dave Lindsay helped to prepare the documents for the Notice of Appeal. When Dave came with me to the Ontario Court of Appeal on September 22, 2000 to file the Notice of Appeal the clerk refused to accept the documents citing a Rule that stated that no Agent could represent me at the Court of Appeal. I could only represent myself or be represented by a solicitor. I had to return to Ottawa and take Dave Lindsay's name off all the documents. I had them reprinted and I re-served on September 28, 2000.

By agreement of consent from Roger Leclaire (the Crown Laywer) and Roger Mills (the lawyer for the Ottawa-Carleton District School Board) I have until December 21, 2000 to perfect and serve my Appeal. Roger Leclaire has advised me that he will not communicate any more with Dave Lindsay since he cannot be Agent for my Appeal. Roger Leclaire has also faxed me a letter expressing his intention to bring an application for dismissal of the Appeal as filed on the basis that the monetary amount in issue is within the exclusive jurisdiction of the Divisional Court and thereby depriving the Court of Appeal of jurisdiction in this mater. So what now??
I do not have sufficient knowledge of the required court procedures, nor do I have any
previous experience presenting arguments in court, therefore I had two choices. One to
drop the Appeal. The other to engage a solicitor to act on my behalf.
I am currently adjusting to a pension income which just covers my monthly commitments and
the expenses of this ongoing CCRA challenge have drained my resources to the point where I
considered dropping the Appeal. Discussions with various people from the
"Detax/Untax/Refusetax" Networks have encouraged me to continue by offering to
come forth with immediate financial support.
On Wednesday, November 29th, 2000 I retained Michael Swinwood (lawyer from Almonte, Ontario) to argue the Appeal on my behalf. Dave Lindsay is coming to Ottawa on December 9th and he has agreed to help Michael perfect the Appeal documents. Dave is an excellent researcher and resource person who can offer much support to Michael. Together they will make a very strong team.
As some readers already know, Michael Swinwood has already been retained by Brad Medd for his Appeal with CCRA in Lindsay, Ontario. The documents for Brad Medd's Appeal were filed with the Court in Lindsay, Ontario on October 27th, 2000. The court has not yet set a date for his Appeal to be heard.
More recently Jean-Serge: Brisson has retained Michael Swinwood as his solicitor for his Appeal re: his seat belt challenge with the Province of Ontario which is scheduled to be heard in L'Orignal, Ontario in April 2001.
Notes:
I have just learned that Byrun Fox scored a significant victory against CCRA in a courtroom in New Westminster, B.C. on November 15, 2000. It is my understanding that one person can use another jurisprudence to defend your point. Since Byrun has had the CCRA charges against him dismissed, I ought not be judged differently. The question is: Is Byrun's victory relevant to my Appeal of the CCRA challenge? Jacques Normandin's research may also be relevant to my Appeal case.
Is it possible to file a Counter-Claim as part of my Appeal to use Jacques Normandin's and/or Byrun Fox's cases?
