Subject: UPDATE: R vs. McElheran - Crown Appeals Dismissal of Failing to File Charge

While at work yesterday, I received a pleasant phone call from a member of the RCMP who was instructed by the DEPARTMENT OF JUSTICE to have a meeting with me to talk. I accepted and arranged a quiet, non-threating meeting place where we could sit down and converse.

The RCMP member, shortly after arriving with his partner at the designated place, presented a "NOTICE OF APPEAL" appealing the Dismissal Ruling of Jan. 8, 2001, by Judge Delong at the Alberta Provincial Court of the tax department's charge of "Failing to File a Tax Return" and served it upon me. Not only was I pleased to have this meeting but was also accepting of the APPEAL NOTICE. 

I am not in the least bothered by the APPEAL filed by Mr. Vern Brewer the DEPARTMENT OF JUSTICE, but am disgusted as to who Mr. Brewer USED to serve his APPEAL NOTICE.

The NOTICE was served by two MAJOR DRUG CRIMES INVESTIGATORS of the RCMP who work in the Investigations Branch of the MAJOR DRUG SQUAD. I am not sure whether to feel honoured by this or outraged at the carelessness and abuse of Mr. Vern Brewer of JUSTICE CANADA to make such a decision which wasted the valuable time and resources of this level of RCMP to serve me a document that a bailiff/process server could have easily carried out.

As this office of the DEPARTMENT OF JUSTICE is known by myself and others to act out in this senseless and covert manner regularly, I encourage that the citizens of this Country, who find Mr. Brewer's panic reaction, to be wrong, speak out against his abuse of our much needed and under-manned RCMP members, by letting Mr. Vern Brewer of JUSTICE CANADA and our Federal Justice Minister know what you think.

HIGH LEVEL, MAJOR CRIME SQUADS OF THE RCMP HAVE MORE IMPORTANT THINGS TO DO AND REAL CRIMES TO INVESTIGATE AND CRIMINALS TO CHASE THAN TO WASTE THEIR TIME AS PROCESS SERVERS.

The Appeal filed by Mr. Brewer is scheduled for THE COURT OF QUEEN'S BENCH, JUDICIAL DISTRICT OF CALGARY, on Fri. April 16, 2001 at 10 am.
