I, Thomas: Kennedy, of the City of Ottawa, in the Province of Ontario,
make oath and say that:
1. I am the Informant, Applicant in this matter and as such have personal knowledge of the facts herein deposed to by me.
2. On May 17, 2002 I filed two informations against Richard Warman, alleging offences under s. 300 and s. 346 of the Criminal Code of Canada. I am alleging libel and extortion.
See attached Exhibit "A"
3. In support of these charges, I filed with the Justice of the Peace an affidavit containing the letter which I alleged to have contained libellous statements and amounting to extortion under the Criminal Code, along with other relevant evidence and documents attached thereto.

4. Justice of the Peace Binda briefly heard my oral allegations in support of these informations and issued a decision on May 27, 2002 denying process. Other than a generic statement to the effect that evidence was "insufficient" to conclude that a case has been made out, no detailed reasons were provided to me as to why process was not issued in respect of my informations.

5. The informations I laid were allegations of libel and extortion. I provided some evidence on each essential element of each offence at this hearing before Justice of the Peace Binda.

6. I make this affidavit true and correct knowing it has the same force and effect as if sworn to in a court of law.

Dear Sir:
On Friday, September 20th, 2002, I attended Courtroom 5 where the charges against Richard Warman were listed as numbers 346, 347 and 348.
Richard Warman was not present. Apparently there was no affidavit of service that he has been served the three summons that you issued on August 30th, 2002.
The matters were adjourned until October 18th, 2002.
It is my understanding that the court staff will now issue three new summons with the revised date of October 18th, 2002.
Is there anything else that I have to do? It is my understanding that the process servers across from Courtroom 2 will serve Richard Warman. Please confirm that indeed this is correct.

Richard Warman is to appear before the presiding judge in Courtroom 5 on Friday, October 18th, 2002, at 8:30 AM.

Dear Hillary McCormack:
In the matter of the Summons to Richard Warman who is charged with one criminal offense of defamatory libel, contrary to Section 300 of the Criminal Code of Canada and two offenses of false accusations contrary to Section 346 (1.1) (b) of the Criminal Code of Canada please be advised that something very strange occurred on Friday, Ocotber 18th, 2002.
Richard Warman did not appear before the presiding judge in Courtroom 5 on Friday, October 18th, 2002. I waited in Courtroom 5 all morning until 11:35 AM when his name was called. He was not present. Mike Boyce, the representative for the Crown Attorney’s Office told the judge that Richard Warman had telephoned the Crown Attorney’s Office and made an arrangement whereby he would not have to attend court on October 18th, 2002. The case was re-listed for November 18th, 2002 at 8:30 AM in Courtroom 5.
My understanding from reading the Criminal Code of Canada is that when a person is accused with an indictable offence s/he must appear in court to answer to the charge.
Richard Warman did not follow the Criminal Code of Canada by being absent when his name was called on Friday, October 18th in Courtroom 5 at 161 Elgin St., Ottawa, Ontario.
Please show me the exact section of the Criminal Code of Canada which permitted the Crown Attorney’s Office to excuse Richard Warman from being present in Courtroom 5 at 161 Elgin St., Ottawa, Ontario.
